Trump Issues New Guidelines for ICE Operations in or near Courthouses

Enforcement Actions in or near Courthouses


If ICE officers and agents have “credible information” that a targeted noncitizen is present at a specific location, they may apprehend, arrest, interview, or search a noncitizen in or near a courthouse. These actions are to be carried out despite the laws of the local jurisdiction.


Targeted non-citizens include:

  • “National security or public safety threats”

  • Noncitizens with criminal convictions

  • Gang members

  • Noncitizens who have been ordered removed from the US but have failed to depart

  • Noncitizens who have unlawfully entered the country after being removed

Those arrested along with the targeted noncitizen, such as family or friends accompanying them to the courthouse, will be evaluated on a case by case basis. 


While ICE agents and officers should refrain from carrying out enforcement operations in or near courts dedicated to non-criminal proceedings, they may do so with the permission of a supervisor who deems it necessary to their operations.
