Expanded Expedited Removal
Expedited removal allows immigration officers to deport someone without a court hearing or opportunity to appeal.
Trump has ordered the expansion of expedited removal which allows officers to employ expedited removal anywhere in the US if the apprehended noncitizens cannot prove they have been lawfully admitted or paroled into the US or have been continuously present in the US for two years.
Normally, noncitizens undergoing expedited removal are entitled to apply for asylum if they fear persecution and torture in their home country. However, the rapid policy changes under Trump’s administration bring into question this possibility.
In addition to undocumented noncitizens, lawfully admitted noncitizens could be at risk if they are caught up in ICE enforcement operations without proof. Expedited removal would deprive them of the opportunity to provide evidence in a hearing and appeal their case.
