When a Genocide Warning Comes, We Must Listen

When Oscar Davies (@nonbinarybarrister) posted their recent video on the Lemkin Institutes’s Red Flag Alert for the UK, they didn’t mince words. They said plainly: “What if I told you that the UK is under a genocidal alert for trans and intersex people?”
This isn’t rhetoric. This isn’t an exaggeration. This is a formal warning from one of the world’s foremost genocide prevention bodies.
In its Red Flag Alert issued in June 2025, the Lemkin Institue for Genocide Prevention states that current UK policies toward trans and intersex people meet the internationally recognised ninth stage of genocide: Denial of identity.
It’s not just alarming – it’s heartbreaking. And it demands action.
The Supreme Court’s Decision: A Turning Point
In April 2025, the UK Supreme Court ruled that the word “sex” in the Equality Act must be interpreted to mean biological sex – even though the word biological doesn’t appear in the legislation.
The implications were immediate and profound.
Soon after, the Equality and Human Rights Commission (EHRC) issued interim guidance that further restricted access to single-sex spaces. The effect? Trans people are once again being excluded from bathrooms, changing rooms, and shelters – places that impact not only dignity and privacy, but safety.
Intersex identities? Completely erased in the process.
This isn’t a debate over policy nuance. This is about whether people are allowed to exist as themselves in public life.
Genocide Doesn’t Begin with Violence – It Begins with Erasure
As the Lemkin Institute outlines, genocide rarely begins with outright violence. It begins with dehumanisation, legal erasure, hostile media narratives, and the removal of rights.
And it starts to look frighteningly familiar when:
Governments re-define identity through law
Trans people are removed from public spaces
Intersex people are rendered invisible
The media frames gender diversity as a threat
Sound familiar? It should.
“If you force someone out of bathrooms”, says Oscar, “you’re curing away at the right to exist themselves”.
When genocide prevention experts raised a red flag, we don’t debate the semantics. We stop. We reflect. We act.
Trans and Intersex People Exist. Full Stop.
The Lemkin Institute puts it plainly:
“No denial or omission in law can erase the concrete reality that trans and intersex people have always and will always exist”
Attempts to erase this class of people are more than discrimination – they constitute intent. Intent to delegitimise, to erase, to remove.
This isn’t about single policies. It’s about the path they collectively pave.
So What Now?
As Oscar says:
“Legally, we must challenge the Supreme Court’s ‘biological sex’ interpretation, the EHRC’s exclusionary interim rules, and media and government erasure campaigns”.
Here’s how you can take action:
✅ Write to your MP.
It matters. MPs do listen to constituents. Ask them to oppose exclusionary interpretations of the Equality Act and stand up for human rights.
✅ Challenge every policy that erases trans and intersex people.
Silence equals complicity. Whether it’s in school, healthcare, media, or government – say something.
✅ Use your voice – not just a rainbow emoji.
Especially if you’re cis. Especially if you have influence. Especially when it’s uncomfortable.
This Is Not Just a Trans Issue. It’s a Human Rights Issue.
